Every machine leaves the bench with a 40-day workmanship warranty. A protection plan is the optional part — ongoing care for as long as you keep it.
Included with every build
40-day limited workmanship warranty
The warranty covers the work: components seated and secured properly, cables connected and routed properly, cooling mounted properly, BIOS and Windows set up properly. If something KC did caused the problem, KC fixes it and you pay nothing for the diagnosis or the labor.
It is not a parts warranty. A component that fails on its own is covered by whoever made it — and KC will help you make that claim.
40 daysFrom the day you pick the machine up or it arrives.
$0 laborOn a confirmed workmanship defect, diagnosis included.
Carry-inService happens at the shop in Walled Lake. Shipping and pickup are not covered.
Email firstA claim counts as on time when you email before day 40 — even if the machine comes in later.
3 daysTo report a scratch or a dent that was there on arrival, with photos.
$50Diagnostic fee if the problem turns out not to be covered. Waived on Premium.
Opening the case or adding a part does not void the warranty. Coverage can be denied for a problem that a modification actually caused — not for the modification itself. The full warranty is below.
Protection plans
Optional · cancel any time
A protection plan is a subscription to service, not longer warranty coverage. It does not replace the 40-day warranty and it does not pay for parts. What it covers is the care around the machine: getting seen first, diagnosis without a fee, cleaning, and KC's labor when a manufacturer approves a replacement.
Plans run month to month, renew on their own, and end no later than 36 months from purchase. Cancel and coverage runs to the end of the month you have paid for.

One machineA plan covers the system it was bought for. A second computer needs its own.
Payment mattersA failed or reversed payment suspends the benefits until it clears.
Want a plan on a machine you already own? Ask KC — a system enrolled after purchase may need an inspection first, and a problem that already existed may not be covered.

40-Day Limited Workmanship Warranty
1. Limited Warranty
1.1. KCS Computers LLC (“KCS”) warrants that the computer system identified on the Customer’s invoice (“System”) will be assembled, installed, and initially configured using reasonable care and generally accepted computer-building practices.
1.2. This is a Limited Workmanship Warranty. It covers defects directly caused by KCS’s assembly, component installation, connections, or initial configuration. It is not a general guarantee against every hardware, software, compatibility, or performance problem.
1.3. This warranty applies only to the original purchaser and is nontransferable, except where applicable law provides otherwise.
2. Warranty Period
1.1. This warranty begins on the date the Customer picks up or receives the System and continues for forty consecutive calendar days.
1.2. A claim is timely when the Customer emails KCS before the 40-day period expires and provides enough information to identify the Customer, the System, and the reported problem. After KCS requests an in-person inspection, the Customer must make the System available to KCS within fourteen calendar days unless KCS approves an extension in writing. A delay may affect coverage when it prevents KCS from determining the original cause of the reported condition.
1.3. The Customer may bring the System to KCS after the warranty period expires if the problem was reported by email before expiration and the System is brought in within a reasonable time after KCS requests inspection. Warranty service does not restart the full 40-day period. Workmanship performed during an approved warranty repair is covered for the longer of:
the remainder of the original warranty period; or
fifteen calendar days after the repaired System is returned to the Customer. The additional 15-day period applies only to the repair performed by KCS.
3. Covered Workmanship
3.1. Covered workmanship defects may include:
improperly seated components;
loose or incorrectly connected cables;
improperly secured hardware;
incorrect fan, pump, storage, or front-panel connections;
improper installation of cooling hardware;
cable routing that interferes with normal operation;
BIOS, firmware, driver, or operating-system settings incorrectly configured by KCS;
physical damage directly caused by KCS during assembly or service; and
another comparable failure directly caused by KCS’s work.
3.2. KCS will determine whether a problem is caused by workmanship after reasonable inspection and diagnosis.
3.3. Unless KCS makes a specific written performance promise, this warranty means only that the System should power on, start normally, recognize the hardware installed by KCS, operate with reasonable stability, and substantially match the specifications listed on the invoice.
3.4. Coverage applies only to the System and components identified in KCS’s invoice, build record, serial-number record, or delivery documentation. KCS may deny a claim involving a substituted component that KCS did not supply or install, except to the extent an unrelated KCS Workmanship Defect remains covered.
4. Component Defects
4.1. A hardware component may fail even when it was properly installed. A failed processor, graphics card, motherboard, memory module, storage device, power supply, cooling device, fan, or other component is not automatically evidence of defective KCS workmanship.
4.2. Individual components may be covered by separate warranties issued by their manufacturers, distributors, or suppliers.
4.3. Manufacturer claims, supplier returns, replacement approval, replacement availability, shipping, and replacement-part condition are controlled by the applicable manufacturer or supplier terms.
4.4. Unless KCS agrees otherwise in writing, this warranty does not require KCS to purchase or advance the cost of a replacement for an independently defective component.
4.5. A separate KCS component-claim policy may apply when manufacturer or supplier assistance is requested.
5. Warranty Remedy
5.1. When KCS confirms a covered workmanship defect, KCS will provide a reasonable corrective remedy without charging the Customer for covered diagnostic or corrective labor.
5.2. KCS may:
reconnect or adjust an affected part;
correct the initial configuration;
repeat the affected assembly work;
repair the workmanship defect;
reinstall an affected component;
replace property directly damaged by KCS; or
refund the amount paid for the specific KCS assembly or configuration service that cannot reasonably be corrected.
5.3. KCS may select the reasonable remedy based on the nature of the defect, the availability of parts, the cost of correction, and whether the remedy will restore the System to its warranted condition.
5.4. A warranty claim does not automatically entitle the Customer to a full refund, a new computer, an upgrade, a loaner computer, or compensation for inconvenience or time without the System.
5.5. The Customer must provide KCS with a reasonable opportunity to inspect and correct the problem before seeking reimbursement for repair work performed elsewhere, except where applicable law provides otherwise.
6. Making a Claim
6.1. Warranty claims must be submitted by email to the warranty-contact address published on the official KCS website.
6.2. The Customer should include:
full name;
telephone number;
invoice or order number;
System serial number, if available;
date of pickup or delivery;
a description of the problem;
when the problem began;
relevant error messages;
photographs or video when helpful; and
any recent hardware, software, BIOS, or configuration changes.
6.3. KCS may begin with remote troubleshooting and may require the complete System to be brought to KCS before deciding whether the claim is covered.
6.4. Submitting a claim does not automatically establish warranty coverage.
7. Diagnostic Fee
7.1. There is no standard diagnostic fee for a confirmed covered workmanship claim.
7.2. If KCS determines that the reported problem is not covered, the Customer may be charged a diagnostic fee of $50 USD.
7.3. A different diagnostic fee may apply only when:
the different fee was clearly disclosed on the official KCS website before diagnosis;
the fee was disclosed before KCS began diagnosis; and
the Customer authorized the fee.
7.4. The diagnostic fee may apply when KCS cannot reproduce the problem or determines that the condition is caused by a component defect, software, customer modification, accident, external equipment, environmental condition, or another excluded cause.
7.5. KCS will not perform additional paid work without Customer authorization. All proposed charges will be disclosed in USD before the work is performed.
8. Carry-In Service
8.1. Warranty service is provided at KCS’s designated place of business.
8.2. The Customer is responsible for bringing the System to KCS and retrieving it after service.
8.3. KCS does not pay shipping, delivery, pickup, courier, travel, or transportation expenses under this warranty.
8.4. Damage caused during Customer transportation, handling, or inadequate packaging is not covered unless KCS directly caused the damage or applicable law provides otherwise.
9. Exclusions
9.1. This warranty does not cover a problem caused or materially contributed to by:
accidental damage, impact, dropping, crushing, or improper handling;
liquid exposure;
broken glass, ports, connectors, case parts, or pins after delivery;
lightning, power surges, unstable electrical service, improper outlets, or incorrect voltage;
blocked ventilation, excessive dust, grease, debris, or inadequate maintenance;
incompatible hardware or accessories;
software installed, removed, or changed after delivery;
viruses, malware, ransomware, unauthorized software, or account problems;
operating-system or application updates;
internet, network, server, subscription, or online-service problems;
theft, loss, abuse, misuse, or deliberate damage; or
operation outside the applicable component manufacturer’s specifications.
9.1.5. Ordinary dust accumulation or a Customer Modification does not automatically cancel the entire warranty. Coverage may be denied only to the extent the condition caused or contributed to the reported problem.
10. Customer Modifications
10.1. Opening the System, installing a component, changing a setting, or using another repair provider does not automatically void all warranty coverage.
10.2. KCS may deny coverage for a condition caused or materially contributed to by:
improper component installation;
incompatible hardware;
third-party repair;
overclocking or undervolting;
changed power, voltage, thermal, fan, or pump settings;
improper BIOS or firmware changes;
failed firmware updates;
custom liquid cooling;
altered internal wiring;
physical damage occurring during modification; or
failure to disclose relevant modifications during diagnosis. An unrelated KCS workmanship defect may remain covered.
11. Cosmetic Conditions
11.1. A cosmetic defect or discrepancy that existed when the Customer received the System must be reported by email within 3 calendar days after pickup or delivery. A cosmetic claim must include clear photographs sufficient to identify the reported condition. KCS may compare the claim with photographs and records created before or at delivery.
11.2. The Customer should provide clear photographs or video.
11.3. This warranty does not cover scratches, dents, impact damage, ordinary wear, fingerprints, dust, minor finish differences, normal lighting or color variations, or cosmetic damage occurring after delivery unless directly caused by KCS workmanship.
12. Software and Performance
12.1. Except for initial setup performed incorrectly by KCS, this warranty does not cover:
customer-installed or customer-modified software;
malware or viruses;
application or game bugs;
forgotten passwords or lost account access;
subscription or license expiration;
online-service interruptions;
operating-system or application updates; or
deleted or altered system files.
12.2. Unless expressly promised in writing, KCS does not guarantee:
a particular frame rate;
a particular benchmark result;
a specific temperature or noise level;
compatibility with every application, game, peripheral, or future update;
a particular internet speed; or
performance for a specialized purpose that was not documented in writing before purchase.
13. Data and Privacy
13.1. The Customer is responsible for maintaining a current backup of all important data before bringing the System to KCS.
13.2. Computer diagnosis and repair may involve a risk of data loss, corruption, alteration, or deletion. KCS does not guarantee that files, programs, accounts, settings, or other information will be preserved.
13.3. The Customer authorizes KCS to access system settings, diagnostic logs, software, user accounts, and files only to the extent reasonably necessary to diagnose, test, or repair the System.
13.4. KCS will use reasonable care to limit access to information relevant to the authorized service.
13.5. KCS will obtain Customer authorization before intentionally erasing a storage device or reinstalling the operating system, unless the Customer previously provided written authorization.
14. Service Timing
14.1. KCS will use reasonable efforts to complete warranty service.
14.2. Unless KCS makes a specific written commitment, appointment dates and completion dates are estimates and are not guaranteed.
14.3. Service time may be affected by diagnosis, workload, Customer response time, component availability, manufacturer or supplier processing, delivery delays, illness, emergencies, severe weather, or other events outside KCS’s reasonable control.
14.4. KCS is not required to provide loaner, rental, or substitute equipment.
15. Limitation of Damages
15.1. To the extent permitted by applicable law, KCS is not responsible under this warranty for indirect, incidental, special, punitive, or consequential damages. Examples may include:
lost profits or revenue;
business interruption;
loss of business opportunity;
loss of use;
rental or substitute-equipment costs;
lost work, school, gaming, or personal time;
inconvenience;
lost subscriptions or software licenses; and
data loss resulting from the Customer’s failure to maintain a reasonable backup.
15.2. Nothing in this warranty excludes or limits liability for fraud, intentional misconduct, personal injury where liability cannot legally be limited, or another right or remedy that applicable law does not permit KCS to exclude.
15.3. Nothing prevents the Customer from pursuing a remedy available under applicable law if KCS’s warranty remedy fails of its essential purpose
16. Implied Warranties and Legal Rights
16.1. This Limited Warranty does not disclaim or eliminate an implied warranty or consumer right that cannot lawfully be disclaimed or eliminated.
16.2. This document does not independently impose a 40-day limitation on the duration of an implied warranty. Nothing in this warranty eliminates:
a nonwaivable consumer right;
a remedy required by applicable law;
liability that cannot legally be excluded;
an authorized written promise made by KCS; or
rights provided by a component manufacturer, distributor, or supplier.
16.3. This warranty gives the Customer specific legal rights. The Customer may also have other rights that vary by jurisdiction.
17. Michigan Law and Venue
17.1. To the extent permitted by applicable law, this warranty is governed by the laws of the State of Michigan.
17.2. A legal proceeding relating to this warranty may be brought in a court with lawful jurisdiction located in Oakland County, Michigan.
17.3. This provision does not prevent the Customer from using another lawful venue, small-claims procedure, government complaint process, or remedy that cannot legally be waived.
17.4. This warranty does not independently require mandatory arbitration. A dispute may be subject to a separate arbitration agreement accepted by KCS and the Customer.
18. Separate Care Plan
18.1. The KCS Care Plan is an optional paid service agreement.
18.2. It is separate from this Limited Warranty and does not replace, reduce, or condition any right provided under this warranty.
18.3. Care Plan services, limits, exclusions, term, price, cancellation rights, and other conditions are governed by the separate Care Plan agreement.
19. Complete Warranty
19.1. This document, together with any authorized System-specific warranty term stated on the Customer’s invoice or written order documents, constitutes the complete KCS Limited Workmanship Warranty.
19.2. An oral statement does not modify this warranty unless KCS confirms the statement in an authorized writing.
19.3. If part of this warranty is unenforceable, that part will be limited only to the extent necessary, and the remaining provisions will continue in effect.
19.4. Applicable federal, state, and local law controls where it provides a right or requirement that cannot be waived. Protection Plan Premium — Service Agreement
The KCS Protection Plan Premium (“Protection Plan” or “Plan”) is an optional paid month-to-month service agreement offered by KCS Computers LLC (“KCS”). The Protection Plan is separate from the KCS 40-Day Limited Workmanship Warranty. Purchasing the Protection Plan is not required to receive warranty service, and the Protection Plan does not reduce, replace, or limit any rights provided under the KCS Limited Workmanship Warranty or applicable law. The current subscription price and billing terms are displayed through the official KCS website or authorized checkout system at the time of enrollment. The Protection Plan provides the services and support specifically described in these terms. It is not accidental-damage insurance and does not provide unlimited repairs or automatic replacement of failed computer components.
1. Plan Term and Renewal
1.1 Month-to-Month Plan
The Protection Plan operates on a month-to-month subscription basis. Unless it is paid up front for the price listed in Shopify. The Plan begins on the effective enrollment date shown in KCS’s records and automatically renews each month until canceled or terminated in accordance with these terms. The Plan will last no more than 36 months from the time of purchase.
1.2 Automatic Billing
By enrolling in the Protection Plan, the Customer authorizes recurring monthly billing through the payment method selected during enrollment. Payment information is processed through KCS’s authorized payment platform.
1.3 Active Coverage
Protection Plan benefits remain available only while:
the subscription is active;
required payments remain current;
the covered System remains eligible; and
the Customer complies with the reasonable requirements of the Plan.
2. Covered System
The Protection Plan applies only to the KCS computer system associated with the Customer’s applicable invoice, order number, serial number, or Protection Plan enrollment record (“System”). Unless expressly stated otherwise, the Protection Plan does not automatically cover:
additional computers;
monitors;
keyboards;
mice;
headsets;
speakers;
printers;
networking equipment;
external storage devices;
third-party accessories; or
devices not specifically enrolled in the Protection Plan. Each additional computer may require separate enrollment.
3. Eligibility
KCS may require reasonable proof of:
System ownership;
original purchase;
System serial number;
active Protection Plan status; and
Customer identity before providing Plan services.
4. When Plan Benefits Begin
4.1 Purchased With the System
When the Protection Plan is purchased at the same time as an eligible KCS System, Plan benefits begin on the System’s pickup or delivery date unless otherwise stated during enrollment.
4.2 Purchased After the System
When a Customer enrolls an existing System after the original purchase, KCS may require:
a waiting period;
System inspection;
diagnostic testing; or
confirmation that the System does not have a pre-existing condition. A problem that existed or was reasonably apparent before enrollment is not automatically covered merely because the Customer later purchases the Protection Plan. KCS may request reasonable evidence concerning when the condition began.
5. Priority Scheduling
Protection Plan Customers receive priority scheduling for eligible service requests. Priority scheduling means KCS will make reasonable efforts to offer an active Protection Plan Customer an earlier available appointment than a comparable non-Plan paid-service request. Priority scheduling does not guarantee:
immediate service;
same-day service;
next-day service;
a specific repair-completion date; or
uninterrupted availability. KCS may prioritize emergencies, existing appointments, or work KCS is legally or contractually required to complete.
6. Diagnostic Testing and Troubleshooting
KCS will provide reasonable diagnostic testing and troubleshooting for eligible System problems while the Protection Plan is active. Diagnostic services may include:
hardware testing;
basic software diagnosis;
temperature review;
storage-health testing;
memory testing;
startup and stability testing;
review of relevant error messages;
review of system logs; and
other reasonable diagnostic procedures selected by KCS. The Protection Plan may waive KCS’s normal diagnostic fee for eligible Plan service. Waiver of the diagnostic fee does not mean that all resulting repairs, replacement parts, software services, or third-party expenses are included.
7. Remote Technical Support
KCS may provide reasonable remote troubleshooting when the reported issue can appropriately be handled remotely. Remote support may include assistance with:
basic Windows issues;
device drivers;
basic hardware or peripheral configuration;
startup problems;
basic software configuration;
general performance concerns; and
other issues KCS determines can reasonably be handled remotely. KCS may require the System to be brought to KCS when remote troubleshooting is insufficient. Remote support is subject to reasonable availability and is not guaranteed to be immediately available.
8. System Health Checks
KCS may perform general System health checks that can include:
operating temperatures;
cooling operation;
fan operation;
storage health;
memory stability;
visible cable and connection condition;
dust buildup;
basic system stability;
relevant driver status; and
other reasonable system-health indicators. A System health check is preventative maintenance and does not guarantee that a component will not fail in the future.
9. Annual Comprehensive System Health Check
An active Premium Protection Plan includes an annual comprehensive System health check. The annual health check may include:
general hardware inspection;
temperature and cooling review;
memory testing;
storage-health testing;
basic stability testing;
driver and firmware review;
visual internal inspection;
fan and airflow inspection; and
reasonable preventative-maintenance recommendations. The annual health check must be scheduled with KCS and does not automatically include replacement parts, upgrades, repairs unrelated to the inspection, or third-party expenses. Unused annual health checks do not accumulate or convert into cash, credits, or other services unless KCS expressly agrees otherwise.
10. Preventative Maintenance and Internal Cleaning
The Protection Plan includes reasonable preventative maintenance and internal cleaning when appropriate. This may include:
removal of ordinary internal dust;
cleaning accessible intake areas;
cleaning accessible exhaust areas;
fan inspection;
accessible cable and connection inspection; and
general visual inspection of internal components. The Plan does not include extensive cleaning or restoration caused by:
smoke;
grease;
liquid contamination;
insects;
animal contamination;
corrosive material;
construction debris; or
unusually severe environmental exposure. KCS may treat unusually extensive cleaning as a separate paid service.
11. Driver, Firmware, and Configuration Assistance
KCS may provide reasonable assistance with:
device drivers;
supported firmware;
BIOS settings;
Windows configuration;
basic System configuration;
startup-related settings; and
other configuration issues reasonably related to normal operation of the covered System. KCS is not required to install every available update merely because an update exists. KCS may decline an update when KCS reasonably determines that installing it is unnecessary, unsupported, unstable, or may create an unreasonable risk to the System.
12. Software Support
12.1 Included Assistance
KCS may provide reasonable assistance with software-related issues that affect normal System operation.
12.2 Limitations
The Protection Plan does not guarantee support for every:
third-party application;
video game;
modification or plug-in;
online service;
unsupported operating system;
discontinued program; or
specialized business or professional application. KCS may decline or limit support when:
the software is no longer supported;
specialized vendor assistance is required;
the software was illegally obtained;
the issue originates with a third-party server or service;
the required credentials are unavailable; or
support would create an unreasonable technical or security risk.
13. Operating-System Service
KCS may provide reasonable troubleshooting for the operating system installed on the covered System. When necessary, KCS may recommend:
driver reinstallation;
system repair;
restoration of settings;
system recovery; or
operating-system reinstallation. KCS will obtain Customer authorization before intentionally erasing a storage device or performing an operating-system reinstallation that is expected to remove Customer data.
14. Manufacturer and Supplier Warranty Assistance
When a hardware component appears to have failed, KCS may provide reasonable assistance with an eligible manufacturer, distributor, retailer, or supplier warranty claim. Assistance may include:
diagnosing the suspected component;
identifying the affected component;
locating available purchase information maintained by KCS;
helping identify applicable warranty procedures;
reasonable assistance with claim submission;
removal of an eligible defective component; and
installation of an approved replacement component. KCS does not control:
claim approval;
manufacturer or supplier decisions;
processing times;
replacement availability;
replacement-model selection;
shipping requirements;
third-party charges; or
whether the replacement is new, refurbished, recertified, or functionally equivalent. The Protection Plan does not automatically require KCS to purchase or advance the cost of a replacement component.
15. Replacement-Component Installation
When an eligible replacement component is obtained through a manufacturer, distributor, retailer, supplier, or Customer purchase, KCS may provide reasonable installation labor under the Protection Plan. Unless expressly stated otherwise, the Protection Plan does not pay for:
the replacement component;
shipping;
taxes;
manufacturer charges;
expedited processing;
upgrade costs; or
other third-party expenses. Any separate Customer expense must be disclosed and authorized before KCS charges the Customer.
16. Repairs and Upgrades Outside the Plan
The Protection Plan may provide preferred or discounted KCS labor for certain repairs or upgrades that are not otherwise included. The Protection Plan does not make every repair, upgrade, or requested service free. Replacement components, upgrades, accessories, licenses, and other separately purchased items remain the Customer’s responsibility unless expressly identified as included. KCS will disclose any separate charge in USD before performing paid work.
17. What the Protection Plan Does Not Cover
Unless KCS expressly agrees otherwise in writing, the Protection Plan does not include or pay for:
replacement-part costs;
accidental damage;
liquid damage;
theft or loss;
fire or flood damage;
lightning or power-surge damage;
shipping;
pickup;
delivery;
transportation;
guaranteed data recovery;
lost or corrupted data;
third-party repair bills;
lost profits;
lost income;
business interruption;
substitute-computer expenses;
software licenses;
subscriptions;
internet-service charges;
manufacturer charges;
damage caused by deliberate misuse;
damage caused by improper modifications;
unsupported third-party equipment; or
services not specifically included in these terms.
18. Accidental and Physical Damage
The Protection Plan is not accidental-damage insurance. The Protection Plan does not pay for repair or replacement resulting from:
dropping the System;
impacts;
crushing;
broken glass;
spills;
liquid exposure;
broken connectors;
bent pins;
improper handling;
improper transportation;
animal damage;
insect damage;
deliberate damage; or
other external physical damage. KCS may offer separate paid repair service when repair is reasonably possible.
19. Environmental and Electrical Damage
The Protection Plan does not pay for damage caused by:
lightning;
power surges;
voltage spikes;
unstable electrical service;
improperly wired or grounded outlets;
incorrect voltage;
fire;
flood;
excessive humidity;
condensation;
excessive heat;
blocked ventilation;
severe dust buildup;
smoke;
grease;
corrosion;
conductive debris;
animals; or
insects. Reasonable diagnostic assistance may still be available under an active Protection Plan.
20. Customer Modifications and Third-Party Repairs
Opening or modifying the System does not automatically terminate the entire Protection Plan. However, KCS is not required to repair damage caused or materially contributed to by:
improper component installation;
incompatible hardware;
improper third-party repairs;
overclocking;
undervolting;
unsafe voltage or power changes;
altered thermal protections;
improper BIOS or firmware settings;
failed firmware modifications;
custom cooling modifications;
incorrect internal wiring; or
physical damage occurring during modification or repair. KCS may require original settings or components to be restored when reasonably necessary for diagnosis. An unrelated eligible service may remain available even when another part of the System has been modified.
21. Data and Privacy
The Customer is responsible for maintaining a current backup of important data. KCS does not guarantee preservation of:
documents;
photographs;
videos;
applications;
saved games;
account information;
operating-system settings; or
other stored information. KCS may need to access system settings, logs, applications, accounts, or files when reasonably necessary to diagnose or service the System. KCS will use reasonable care to limit access to information relevant to the authorized service. The Customer should not provide unnecessary confidential or sensitive information.
22. Service Location
The Protection Plan is primarily a carry-in service plan. All physical Protection Plan service is performed at KCS’s designated workshop in Walled Lake, Michigan, unless KCS agrees to another arrangement in writing. The Customer is responsible for bringing the System to KCS and retrieving it after service. Unless KCS agrees otherwise, the Protection Plan does not include:
shipping;
courier service;
pickup;
delivery;
travel; or
on-site service.
23. Service Availability and Turnaround
KCS will use reasonable efforts to provide Protection Plan services. KCS does not guarantee uninterrupted or immediate service availability. Service may be affected by:
existing appointments;
workload;
illness;
emergency;
part availability;
manufacturer or supplier delays;
severe weather;
holidays;
technical complexity; or
other circumstances outside KCS’s reasonable control. Priority scheduling does not guarantee same-day, next-day, or any specific repair-completion time. Any estimated appointment or completion date is an estimate unless KCS expressly guarantees it in writing.
24. Pre-Existing Conditions
The Protection Plan is intended to provide continuing support and maintenance. It is not intended to allow enrollment solely to obtain Plan service for an already-existing problem. A condition that existed or was reasonably apparent before the Protection Plan became effective may be excluded. KCS may require inspection or diagnosis of a System enrolled after its original purchase. KCS may offer separate paid service for a pre-existing condition.
25. Failed or Reversed Payments
Protection Plan benefits may be suspended if a recurring payment:
fails;
is declined;
is reversed;
is disputed; or
otherwise remains unpaid. KCS may restore Plan benefits after the payment issue is resolved. KCS is not required to provide Plan benefits during an inactive or unpaid period. A later successful payment does not automatically make KCS responsible for conditions or service requests arising during a period in which the Plan was inactive.
26. Cancellation
The Protection Plan continues month-to-month until canceled. The Customer may cancel using a method provided through the KCS website, customer account, authorized payment platform, or another method accepted by KCS. Unless otherwise required by law or expressly stated at enrollment:
cancellation stops future renewals;
previously paid billing periods are not automatically prorated;
benefits remain available through the end of the current paid billing period unless the Plan is otherwise properly terminated; and
cancellation does not eliminate charges properly incurred before cancellation.
27. KCS Suspension or Termination
KCS may reasonably suspend or terminate Protection Plan service because of:
unpaid charges;
fraudulent enrollment;
misuse of the Plan;
materially false information;
abusive or threatening conduct;
repeated attempts to obtain service for a different System;
unreasonable interference with diagnosis or repair;
unsafe System conditions; or
circumstances making continued service unlawful or impracticable. KCS will not terminate a Protection Plan merely to avoid performing a legitimate Plan obligation. Any notice or refund required by applicable law will be provided.
28. Reasonable Use of Plan Services
The Protection Plan provides reasonable ongoing service and support for the covered System. The Protection Plan does not create an unlimited right to:
continuous technical support;
unlimited repair labor;
repeated unnecessary inspections;
unlimited cleaning;
unlimited software installation;
unlimited operating-system reinstallations;
unlimited hardware upgrades; or
services unrelated to maintaining or supporting the covered System. KCS may establish reasonable limits when requested service becomes excessive, unrelated to legitimate System support, or materially exceeds the intended purpose of the Protection Plan. KCS will not use this provision solely to deny reasonable legitimate service requests because the Customer has previously used Plan benefits.
29. Relationship to the KCS Limited Workmanship Warranty
Overlap With the Limited Workmanship Warranty The KCS Protection Plan may be active at the same time as the KCS 40-Day Limited Workmanship Warranty. During the 40-Day Limited Workmanship Warranty period, a condition that is covered by that warranty will be handled under the Limited Workmanship Warranty at no additional charge to the Customer. The Protection Plan provides separate benefits during the same period, including eligible priority scheduling, technical support, diagnostics, manufacturer or supplier warranty assistance, and other Plan services described in these terms. Purchasing the Protection Plan does not require the Customer to pay for a service that KCS is otherwise obligated to provide under the KCS 40-Day Limited Workmanship Warranty. The expiration of the Limited Workmanship Warranty does not automatically terminate an otherwise active Protection Plan.
30. Limitation of Damages
To the extent permitted by applicable law, KCS is not responsible under the Protection Plan for indirect, incidental, special, punitive, or consequential damages. Examples may include:
lost profits;
lost revenue;
business interruption;
loss of business opportunity;
loss of use;
substitute-equipment expenses;
lost work, school, gaming, or personal time;
inconvenience;
loss of anticipated savings; and
data loss resulting from the Customer’s failure to maintain a reasonable current backup. Nothing in this agreement eliminates liability or a legal right that cannot lawfully be excluded or limited.
31. Legal Rights
Nothing in the Protection Plan is intended to:
eliminate a nonwaivable consumer right;
eliminate a remedy required by applicable law;
disclaim liability that cannot legally be disclaimed;
reduce rights under the KCS Limited Workmanship Warranty;
reduce applicable manufacturer, distributor, retailer, or supplier warranty rights; or
prevent the Customer from contacting a government or consumer-protection agency. Where these terms conflict with a nonwaivable requirement of applicable law, applicable law controls.
32. Michigan Law and Venue
To the extent permitted by applicable law, the Protection Plan is governed by the laws of the State of Michigan. A dispute relating to the Protection Plan may be brought in a court with lawful jurisdiction located in Oakland County, Michigan. Nothing in this section eliminates a nonwaivable right to use another lawful venue, small-claims procedure, government complaint process, or other legally available remedy. The Protection Plan does not independently require mandatory arbitration unless KCS and the Customer separately enter into an enforceable arbitration agreement.
33. Complete Protection Plan Agreement
These terms, together with:
the Protection Plan description displayed during enrollment;
the applicable enrollment or subscription record;
the Customer’s applicable KCS order or invoice; and
any System-specific written term authorized by KCS constitute the KCS Protection Plan Premium Service Agreement. The subscription price displayed through KCS’s authorized website, checkout, or payment platform controls the price charged for the applicable billing period. An oral statement does not modify these terms unless KCS confirms the modification in an authorized writing. If one provision is determined to be unenforceable, that provision will be limited only to the extent necessary, and the remaining provisions will continue in effect.
34. Service Requests
Protection Plan service requests must be submitted through the service-request or contact method published on the official KCS website. KCS may request:
Customer name;
invoice or order number;
System serial number;
description of the problem;
photographs or video;
information concerning recent modifications;
troubleshooting information; and
an in-person inspection before determining the appropriate service. Submitting a service request does not automatically establish that a requested repair, replacement part, or service is included under the Protection Plan.
35. Effective Date
These KCS Protection Plan Premium Terms and Coverage are effective September 15, 2026 and apply to Protection Plans enrolled under this version of the agreement. KCS may revise these terms for future enrollments. Any revised version will identify its effective date. Changes to terms for an existing active subscription will be made only as permitted by applicable law and any applicable notice requirements.
